San Diego Spousal Support Attorney

Helping resolve alimony disputes and create practical spousal support agreements in divorce proceedings

There are many decisions that must be made during a divorce that can cause friction. While child support is determined by the court using a strict formula, spousal support allows room for flexibility based on the situation and needs of each spouse.

At the San Diego law offices of divorce attorney Marilyn Bierer, our goal is to carefully evaluate our clients' needs and goals to determine an adequate and fair arrangement for spousal support. We can help you negotiate an amicable settlement with your ex, or find resolution through litigation when an arrangement cannot be reached any other way.

Determinations in Spousal Support Agreements

If a divorcing couple is unable to agree on the need for or terms of spousal support (also called alimony or spousal maintenance), a judge will determine what is appropriate and award spousal support based on several factors, such as:

  • Each person's current income and earning capacity
  • Qualifications, job skills and potential earnings
  • Age and health
  • Assets and debts
  • Length of the marriage
  • Standard of living established during the marriage

Spousal support can be temporary or indefinite, often based on the length of the marriage. As a general rule, marriages lasting more than 10 years may result in spousal support payments being paid until the supported party's death or remarriage. Marriages lasting less than 10 years often include alimony payments that are paid for one-half the length of the marriage.

When determining the need for spousal support, a divorce lawyer from Bierer & Associates is a valuable advocate to help support your best interests, to either help secure or fight support. Using our more than 15 years of divorce and family law experience, we will help negotiate with your ex when possible and fight for your best interests at trial when needed.
